These terms cover what you can expect from us and what we expect from you when you use this site or buy from it. Read them before you order. Placing an order means you accept them.
1. Who we are and who you are
This site is operated by KINETICS LLC, trading as Shadebourne ("Shadebourne", "we", "us"), 135 E Harmon Ave, Unit 19-702, Las Vegas NV 89109, United States. These terms apply to every visitor, user, and customer of this site. To place an order you must be at least 18 years old and able to enter a binding contract.
2. Products and how we describe them
We describe the Shadebourne Pillow as accurately as we can, including its measurements and materials. Colors shown on a screen vary by display. Specifications and packaging can change as we improve the product, and we will not treat a minor change as a defect. If a change is material, we will say so on the product page before you buy.
The Shadebourne Pillow is a consumer sleep product. It is not a medical device. It is not intended to diagnose, treat, cure, or prevent any condition, and nothing on this site should be read as medical advice. If you have a persistent problem with your neck, shoulder, or back, speak to a qualified professional.
3. Prices, errors, and availability
Prices are in United States dollars and exclude sales tax and shipping unless we state otherwise. We can change prices at any time before you place an order. We can also limit quantities, restrict sales by region, and discontinue a product.
Occasionally a price, description, or availability figure is wrong. If an error affects an order you have placed, we will contact you before shipping and give you the choice of confirming at the corrected price or cancelling for a full refund. We are not obliged to fulfil an order placed at an obviously incorrect price.
4. Orders
Your order is an offer to buy. Our order confirmation email acknowledges that we received it, and is not acceptance. The contract forms when we ship. We may refuse or cancel any order, including for suspected fraud, resale, an address we cannot ship to, or a stock shortage. If we cancel, we refund you in full.
5. Pre-orders and ship dates
Where a product is sold before stock is on hand, the product page and checkout will say so and will state the expected ship window. That window is an estimate based on the best information we have, not a guarantee. If it moves, we will email you with the new date and you can cancel for a full refund at any point before your order ships.
6. Shipping and delivery
Delivery estimates are estimates. Once a carrier has your package, transit time is outside our control. Title and risk of loss pass to you when the carrier delivers. If a package arrives damaged, tell us within 7 days of delivery and we will replace it. See the refund policy for how that works.
7. Returns

8. Your use of this site
You may not use this site to break the law, to scrape or copy it at scale, to probe or interfere with its security, to upload harmful code, or to impersonate anyone. We may suspend access to anyone who does.
9. Intellectual property
The Shadebourne name, logo, product designs, photography, copy, and page code on this site belong to us or our licensors. You may not copy, reproduce, or use them commercially without written permission. Buying a product does not transfer any of these rights.
10. Reviews, feedback, and anything you send us
If you send us a review, photo, comment, or idea, you keep ownership of it and give us a non-exclusive, royalty free, worldwide licence to use, reproduce, and publish it in our marketing, with attribution to your first name or handle. Do not send us anything that is not yours to send. We may edit for length or remove content that is abusive, false, or unlawful. We are not obliged to keep any submission confidential or to pay for it.
11. Third party links
This site links to services we do not operate, including payment providers and social platforms. Their terms and privacy practices are their own, and we are not responsible for them.
12. Disclaimers
This site is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties that are not expressly stated here, including implied warranties of merchantability and fitness for a particular purpose. We do not warrant that the site will be uninterrupted, error free, or secure.
Nothing in these terms limits any right you have under consumer protection law that cannot be limited by agreement.
13. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from your use of this site or any product bought through it. Our total liability for any claim is limited to the amount you paid for the product that the claim concerns.
14. Indemnity
You agree to indemnify us against claims, losses, and reasonable legal costs arising from your breach of these terms or your misuse of this site.
15. Governing law and disputes
These terms are governed by the laws of the State of Nevada, without regard to its conflict of law rules. Any dispute will be brought in the state or federal courts located in Clark County, Nevada, and you and we consent to that jurisdiction. Before filing anything, email us. Most problems are solved in one message.
16. Severability and waiver
If any provision here is found unenforceable, the rest stays in force. If we do not enforce a provision on one occasion, that is not a waiver of it.
17. Changes to these terms
We may update these terms. The version in force for your order is the one published when you placed it. The date at the top reflects the current version.
